  1.  What is the duty of a Commissioner for Oaths?


           (Rule 11(2)) Essentially, a Commissioner for Oaths verifies the                           identity of the person making the declaration/document and a                         Commissioner for Oaths makes sure that the person understands the             content of the declaration/document.

           根据“宣誓规则”第11条第2款规定,宣誓官必须确保您理解声明/文档中的每             个陈述,以及签署它的后果。如果您不理解,他们有责任阅读并向您解释声             明/文件.

  1.  What can a Commissioner for Oaths do?


           Typically, a Commissioner for Oaths can affirm affidavits and                           statutory declarations. A Commissioner for Oaths can also attest a                   Power of Attorney.

           一般上宣誓官可确认誓章以及法定声明。此外,宣誓官也可以认证/证明授               权书.

           (Rule 9(1)) The powers of an advocate and solicitors appointed as a                 Commissioner for Oaths are as follows:-

           [第 9条第1款]被委任为誓言专员的辩护人和律师的权力如下:-

           (a) receive acknowledgements of a married woman as required by                       law to be taken before a public officer;


           (b) receive acknowledgements of recognizances of bail or bail bonds; 


           (c) administer an oath for the following:-


                 (i) the justification for bail; 


                (ii) taking any affidavit or affirmation;


               (iii) receiving and taking the answer, plea, demurer, disclaimer,                              allegation or examination of any party or parties to any action;


                (iv) the examination of any witness upon any interrogatories or de                         benne esse or in chief on any other occasion;


                  (v) swearing executors and administrators; and


                (vi) any persons in any action, matter or proceeding which is                                   pending or about to be instituted in any court; and 

                       牵涉于诉讼,事项或程序中的任何人,无论是在法庭里待决或将要被                         提起诉讼;及


           (d) taking and receiving statutory declarations.



      3.   Can a Commissioner for Oaths backdate the affirmation of any                  documents?


            No. A Commissioner for Oaths is not permitted to backdate the                          affirmation of any documents. A Commissioner for Oaths must                        insert the current date and it must be the same date as when the                      person signed the documents in front of the Commissioner for Oaths.

            不行。宣誓官是不允许回溯任何已宣誓文件的日期。宣誓当天,出席者必                须在宣誓官的面前签署文件,当文件签署好了,宣誓官必须把当天的日期                输入在文件上;宣誓官输入的日期与签署者的签名日期必须是相同的。

  1.    Can a Commissioner for Oaths refuse to provide his/her                     services?


            (Rule 11(2)(e)) Yes, a Commissioner for Oaths may refuse to provide                 his/her service when the Commissioner for Oaths has credible cause               to suspect that the person before him/her is engaged in deception,                   fraud, duress or any illegal conduct.

            根据“宣誓规则”第11条第2款第e项规定,当宣誓官有可信的原因怀疑出席                者从事或参与骗局,诈骗,威胁或任何非法活动,宣誓官可拒绝提供宣誓/                认证服务。

  1.    Can a Commissioner for Oaths affirm any pre-signed documents     without the person being present?

            在其签署者未出席的情况下,宣誓官能不能确认/宣誓在预先签署好的                文件上?

            (Rule 11(2)) No. This is a serious breach of the duty of a                                      Commissioner for Oaths. The person must be present and sign the                  documents in front of the Commissioner for Oaths.

            根据“宣誓规则”第11条第2款规定, 宣誓官是不允许在其签署者未出席的情              况下,确认/宣誓在预先签署好的文件上。其举止是严重违反宣誓官的职                    责。所以签署者必须得出席及在宣誓官面前签署其文件。

  1.    Can a Commissioner for Oaths go to the hospital or my                       office/house to affirm any document?


            (Rule15(1)(b)) The general rule is that a Commissioner for Oaths                      must only carry out his/her services at his/her approved office                          address.

            (Rule15(1)(2)) A Commissioner for Oaths may carry out his/her                        services at a venue different from his/her approved office address                  only in exceptional circumstances and with the prior approval of                    Chief Justice of the Federal Court of Malaysia.

            根据“宣誓规则”第15条第1款第b项规定,通例则为宣誓官只允许执行其服                务于其指定的公司地址。

            根据“宣誓规则”第15条第1款第2项规定,宣誓官只有在特殊情况下并获得                马来西亚联邦法院首席法官的事先批准,宣誓官则可执行其服务于不同的                地点。

  1.    I am asked to provide a certified true copy (CTC) of documents.       Can a Commissioner for Oaths certify a document as a true copy     of the original?

            我被要求提供证明文件的真实副本(CTC)。 宣誓官可以证明文件为原        件的真实副本吗?

             (Circular dated 13th June 2005) No. A Commissioner for Oaths is not               authorised to certify any document as a true copy of the original.

           【通函于2005年6月13日】不行。宣誓官无权将任何文件证明为原件的真实               副本。

  1.    Can a Commissioner for Oaths be a witness of a person’s                     execution of any agreement, letter or any documents ?


             (Circular dated 03rd November 2015) No. A Commissioner for Oaths               is prohibited to be a witness of a person’s execution of any                                 agreement, letter or any documents, unless permitted by the                             following laws :-

           【通函于2015年11月3日】不行。宣誓官被禁止作为任何人执行任何协议,              信件或任何文件的见证人, 除非以下法律允许:-

            (i) Form 1 and 2 under Section 3 (First Schedule) Power of Attorney                     Act 1949

                 《 1949年授权书法令》第3条(附表1)的表格1和2

            (ii) Money Lending Agreement under section 27(1) of the                                          Moneylenders Act 1951

                 《 1951年放债人法》第27(1)条下的放债协议

            (iii) Guarantee Agreement under section 22 of the Hire Purchase Act                      1967

                 《 1967年租购法》第22条的担保协议

            (iv) Memorandum and Title under section 97(1) of the Sabah Land                         Ordinance (Cap. 68)


            (v) Certificate, under section 84(2) of the Legal Profession Act 1976


  1.    Can a Commissioner for Oaths affirm any statutory declaration       which does not conform to the Statutory Declaration Act, 1960?


             (Circular dated 03rd November 2015) No. A Commissioner for Oaths               is not allowed to affirm any statutory declaration which does not                     conform to the format prescribed in the Statutory Declaration Act,                   1960. The format can be found in the (Schedule of the Statutory                       Declarations Act, 1960).

           【通函于2015年11月3日】不行。宣誓官禁止确认任何不符合“1960年法定                 声明法”规定格式的法定声明。该格式可以在“1960年法定声明法”附表中找               到。

  1.    If two (2) or more persons are signing one (1)                                           declaration/document, must they sign at the same time?


             Yes. All the persons signing the declaration/document must be                           present before the Commissioner for Oaths and sign the                                     declaration/document at the same time.

             是。 所有签署声明/文件的人必须在宣誓官面前并同时在声明/文件上签字.

  1.    Can a person represent a few other people or deponents named       in a declaration?


             No. A Commissioner for Oaths shall only affix his seal to any                             document when all deponents have signed the                                                       declaration/document in his presence.

             不可以。宣誓官只有在所有人都在场的情况下在声明/文件上签字后,方可               在任何文件上加盖公章。

  1.    Can a child or a mentally disordered person make an oath?


            (Rule 11(2)(b)) Yes, but the Commissioner for Oaths must ensure that              the child understands the subject matter involving the oath. The                      child must also be present together with his/her family member. If                  the Commissioner for oaths is of the view that the subject matter                      involving the oath is prejudicial to the child’s benefit, the                                    Commission for Oaths may refuse to undertake his function under                  Rule 11(2)(e); A mentally disordered person may make an oath if the              mental disorder affecting the deponent is not continuous, and at the              time of placing his signature on the document, he is of sound mind                  and understands the subject matter and nature of the oath.

            可以,但是誓言专员必须确保孩子理解涉誓言的内容。孩子也必须在他/她                的家人陪同。根据第11条第2款第e项规定,若誓言专员认为涉及誓言的内                容不利于儿童的利益,宣誓官则可拒绝履行职责;精神障碍者可在其精神                障碍不持续,头脑清晰与解涉及内容的情况下宣誓。

  1.    Can a person who is blind/deaf/mute/illiterate make an oath?


             (Rule 11(2)(b)) Yes, but the Commissioner for Oaths must ensure that               the deponent understands the subject matter and nature of the oath               after reading and explaining the contents of the documents together               with the exhibits annexed.

             根据第11条第2款第b项规定,可以,但宣誓官必须确保被告人在阅读并解               释文件的内容以及所附的证物后,可理解宣誓书的内容和性质。

  1.    Can a Statutory Declaration be filled in with two different pens       with different ink colours?


            The Commission for Oaths Rules 2018 and the Statutory Declaration                Act 1969 (Revised 2016) are silent on this matter. However, it is                        advisable for the Statutory Declaration to be completed using a                        single ink colour and a single type of pen. This is to prevent any                        suspicions with regards to the contents of the Statutory Declaration.                It is also worth noting that the validity of the affirmed documents is                subject to the terms and conditions imposed by the issuing agency or              government department.

           《2018年宣誓局规则》和《 1969年法定声明法》(2016年修订)对此事保              持中立。但是,建议使用单一墨水颜色和单一类型的笔来完成法定声明。                这是为了防止任何人对法定声明的内容产生怀疑。有一点必须注意的是,                文件被确认的有效性将取决于机构或政府部门所规定的条款和条件。

  1.    Can a Commissioner for Oaths assist a deponent to draft a                 Statutory Declaration and charge the deponent an additional           fee? 


            No. A Commissioner for Oaths is prohibited from assisting a                              deponent to draft any documents. Thus, imposing an additional fee                for said service is also prohibited.

            不可以。宣誓官被禁止协助答辩人拟草任何文件。因此,对所述服务征收                 额外费用也是被禁止的。

  1.    What are the fees/charges of a Commissioner for Oaths?


             (Rule 17 & 2nd Schedule) All fees/charges of a Commissioner for                       Oaths are prescribed. A Commissioner for Oaths cannot charge                         anything above and beyond the prescribed fees/charges.

           【第17条和附表2】宣誓官的所有费用均已订明。 宣誓官不能收取超出规定               费用的任何费用。

            Pursuant to a clarification made by Federal Court of Malaysia, the                    fees/charges for a Statutory Declaration remains as RM4.00 for each                declaration.


  1.    What do I need to bring along when I see a Commissioner for           Oaths?


             Apart from the documents which you require the Commissioner for               Oaths to affirm, please bring your original identity document.

  1.    How long does it normally take for my document to be affirmed     by the Commissioner for Oaths?


            Depending on the type and nature of the documents, it would                            usually take about five (5) minutes.
